Acceptable Use Policy (AUP)
IN ORDER TO PROVIDE HIGH QUALITY CUSTOMER SERVICE AND
TO ENSURE THE INTEGRITY OF eWorld INTERNET ACCESS
(“SERVICE”), eWorld HAS ADOPTED THIS ACCEPTABLE USE
POLICY.
PLEASE READ THIS ACCEPTABLE USE POLICY PRIOR TO
ACCESSING THE SERVICE. THE WORD CUSTOMER IS USED HEREIN
TO REFER TO ANY PERSON, ENTITY OR BUSINESS ORGANIZATION
THAT SUBSCRIBES TO THE SERVICE. BY USING THE SERVICE,
CUSTOMER AGREES TO THE TERMS OF THIS ACCEPTABLE USE
POLICY. eWorld RESERVES THE RIGHT TO IMMEDIATELY
TERMINATE THE CUSTOMER’S SERVICE WITHOUT NOTICE, AT
eWorld’s SOLE DISCRETION, IF CUSTOMER OR OTHERS WHO USE
CUSTOMER’S SERVICE, VIOLATE THIS ACCEPTABLE USE POLICY.
eWorld ALSO RESERVES THE RIGHT TO IMMEDIATELY REMOVE ANY
MATERIAL OR INFORMATION THAT VIOLATES THIS POLICY FOR
ANY REASON WHATSOEVER AT eWorld’s SOLE DISCRETION
WITHOUT PRIOR NOTICE.
What is an Acceptable Use Policy?
An Acceptable Use Policy (AUP) lists the conditions that
an Internet Provider or anyone owning equipment
available for public access which is connected to the
Internet puts in place to set the rules and conditions
for anyone using or transiting their network, equipment
and services. The AUP defines the behavior the publisher
deems acceptable for those using their resources and the
sanctions that may be applied to anyone who misuses
those resources.
Scope
The AUP applies to all eWorld customers connecting via
PSTN, ISDN, Permanent connections (wireless / DSL etc.)
or Hosted services and applies equally to any third
party customer or any person accessing eWorld services
or services hosted by eWorld or transiting the eWorld
network. eWorld has two kind of customers – corporate
and residential and this AUP applies to both.
Legal Use
The Services may not be used to send or receive any
material which is offensive, abusive, indecent, obscene,
or menacing; or in breach of confidence, copyright,
privacy or any other rights, or to send or receive any
material, including computer viruses or pornography, the
sending or reception of which transgresses any laws of
Pakistan, whether Civil or Criminal.
eWorld reserves the right to make available any logs of
customer activities to the proper authorities when
legally required and properly requested to do so.
Why has eWorld published an AUP?
We need to make sure that everyone knows what we don’t
allow. The principle of the Internet is really founded
on sharing of resources and if our users abuse this then
other companies will refuse to allow anyone from our
network to access their systems. We also need to be able
to say to other ISPs that their users are transgressing
and show them a copy of our AUP so that they can take
action. We also need to protect our equipment and
systems from direct attack.
What sanctions can eWorld apply?
If we need to we can suspend a customer’s account with
no prior warning and go to court to recover the cost of
any damage done to our systems or reputation. If a
visitor transgresses then we can ask their ISP to take
action and if this doesn’t happen we can disallow access
to anyone from that ISP until the offender has been
dealt with.
How often will the AUP be modified?
Whenever we need to update or change the AUP we will do
so. The new AUP will apply as soon as we publish the
updated document at http://www.eWorld.net.pk/aup.aspx
and any changes will come into effect at the same time.
We hope we don’t have to make changes more often than
necessary but we must be able to react to change in the
Internet and the way it is being used.
What if I don’t agree with the AUP?
You should call eWorld at once on 111-246-246 if you
disagree with any of the conditions on these pages. List
anything that you disagree with and ask if we can offer
an exemption or modify our AUP. Do not use your account
until any dispute has been resolved.
USE
The corporate Internet access service provided to the
Customer is being provided solely for use in Customer’s
business and any unauthorized access by a third party to
e-mail, Internet access, or any other function of the
Service is in violation of this Policy and relieves
eWorld of any affirmative obligations it may have.
Customer is responsible for any misuse of the Service
that occurs through Customer’s account whether by a
member of Customer’s business or an authorized or
unauthorized third-party.
On the other hand, the residential Internet Service is
being provided solely for use in Customer’s household
and any unauthorized access by a third party to e-mail,
Internet access, or any other function of the Service
relieves eWorld of any affirmative obligations it may
have, and is in violation of this Policy. Customer is
responsible for any misuse of the Service that occurs
through Customer’s account whether by a member of
Customer’s household or an authorized or unauthorized
third-party.
Customer will not resell or redistribute, nor allow
others to resell or redistribute, access to the Service
in any manner, except as expressly provided in any
contract for service. The limitation on resale or
redistribution of access includes, but is not limited
to, hosting applications such as the provision of
e-mail, FTP and Telnet access.
eWorld reserves the right to disconnect or reclassify
the Service for failure to comply with any portion of
this provision or this Policy.
Any violation of these policies may lead to prosecution
under provincial and/or federal law and/or termination
of Customer’s Service.
END USERS
Customer is responsible for ensuring that all end users
of the Service comply with this AUP. eWorld may
disconnect Service if an end user violates this AUP. The
Customer must make contact information publicly
available, and must respond in a timely manner to any
complaints. eWorld shall consider any complaints
regarding the Customer’s end users to apply to the
Customer. Customer is responsible for any and all e-mail
addresses associated with the Customer’s account.
The Customer is responsible for any misuse of the
Service, whether by authorized or unauthorized end
users. Therefore, the Customer must take steps to ensure
that others do not gain unauthorized access to the
Service. Customer is solely responsible for the security
of (i) any device Customer chooses to connect to the
Service, including any data stored or shared on that
device and (ii) any access point to the Service.
If the Customer sells or resells advertising or web
space to a third party, then the Customer will be
responsible for the content of such advertising or on
such web space and the actions of such third party.
NO ILLEGAL OR FRAUDULENT USE
Customer will not use, nor allow others to use, the
Service to violate any applicable federal, provincial,
local or international laws. Customer will not use, nor
allow others to use, the Service to commit a crime, act
of terrorism, or fraud, or to plan, encourage or help
others to commit a crime or fraud, including but not
limited to, acts of terrorism, engaging in a pyramid or
ponzi scheme, or sending chain letters.
NO COPYRIGHT OR TRADEMARK INFRINGEMENT
Customer will not use, nor allow others to use, the
Service to send or receive any information which
infringes the patents, trademarks, copyrights, trade
secrets or proprietary rights of any other person,
entity or business organization. This includes, but is
not limited to, digitization of music, movies,
photographs or other copyrighted materials or software.
Customer must obtain appropriate authorization from such
other person or entity prior to sending, receiving or
using such materials. Customer represents and warrants
that Customer is the author and copyright owner and/or
authorized licensee with respect to any hosted content
and Customer further represents and warrants that no
hosted content violates the trademark, copyright, domain
name or intellectual property rights of any third party.
eWorld assumes no responsibility, and Customer assumes
all risks regarding the determination of whether
material is in the public domain, or may otherwise be
used for such purposes.
NO THREATS OR HARASSMENT
Customer will not use, nor allow others to use, the
Service to transmit any material that threatens or
encourages bodily harm or destruction of property or
which harasses, abuses, defames or invades the privacy
of any other person or entity.
NO HARM TO MINORS
Customer will not use, nor allow others to use, the
Service to harm or attempt to harm a minor, including
but not limited to using the Service to send
pornographic, obscene or profane materials.
BLOCKING OF OFFENSIVE WEBSITES
eWorld blocks all such websites that are considered
offensive by Pakistan Telecommunication Authority (PTA).
A recent example is of the cartoon controversy where
many such sites were identified by PTA and we blocked
them as per PTA directive. All such blocked websites are
listed at www.eworld.net.pk/blocked_websites.aspx
NO SPYWARE, MALWARE, ADWARE ETC.
eWorld has a policy to block most, if not all, known
sites suspected of illegal collection of data from
customer’s computers, malicious software as well as
broadcasting of advertisement that can choke a
customer’s Internet connection to eWorld resulting in
slow browsing experience and/or loss of important
customer data.
However, eWorld takes no responsibility and customer
must protect its own computer from such malicious
programs.
eWorld reserves the right to block such customer’s whose
PCs might be infected resulting in unusually high data
transfer, broadcasting and/or excessive bandwidth usage.
NO SPAM/UCE/UBE
Unsolicited Commercial Email (UCE)/Unsolicited Bulk
Email (UBE) and posting of out of topic news articles or
cross posting of news articles to numerous groups is
often called SPAM. Customer will not use, nor allow
others to use, the Service to send unsolicited messages
or materials, bulk e-mail, or other forms of
solicitation (“spamming”). eWorld reserves the right, in
eWorld’s sole discretion, to determine whether such
posting or transmission constitutes unsolicited messages
or materials. This prohibition against spamming is
applicable to mass mailings by Customers in conjunction
with third parties and is designed to maintain Service
quality for all Customers. Mass mailings are those sent
to more than 150 recipients by Customer or in
conjunction with a third party to any group of
recipients. Customer is responsible for maintaining
confirmed opt-in records and must provide them to eWorld
upon request. The term “opt-in” means that recipient has
signed up for mailings voluntarily.
Any person or business entity using eWorld resources for
the transmission of UCE/UBE will have their account
suspended with immediate effect and without prior
warning. Any repeat occurrence may lead to cancellation
of the account without notice or warning. Any costs
incurred by eWorld may be reclaimed from the account
holder.
eWorld Mail Relays may not be used for sending UCE/UBE
or for disguising the origin of any mail sent through
the Internet.
In a similar manner eWorld does not condone the
following actions when posting to Newsgroup.
The cross posting of articles across a range of
newsgroups.
Posting articles which are inappropriate or off topic.
Posting of offensive or hateful articles.
Posting of any articles containing content which
breaches Pakistan law.
Posting of advertisements for products or services.
Abuse of the News service may lead to suspension or
cancellation of a customer account and any costs
incurred by eWorld as a result will be at the charge of
the customer.
NO “HACKING"
Customer will not use, or allow others to use, the
Service to access the accounts of others or to attempt
to penetrate security measures of the Service or other
computer systems (“hacking”) or to cause a disruption of
the Service to other on-line users. This includes, but
is not limited to, achieving or attempting to achieve,
or assisting others in achieving or attempting to
achieve, any unauthorized access to any computer, cable
or telecommunications system, network, software, data,
information, or any other proprietary material. Customer
will not use, or allow others to use, tools designed for
compromising network security, such as password-guessing
programs, cracking tools, packet sniffers or network
probing tools. In addition, Customer will not
participate in, or allow others to participate in, the
collection of e-mail addresses, screen names, or other
identifiers of others (without their prior consent), a
practice known as spidering or harvesting, or
participate in the use of software (including “adware”
or “spyware”) designed to facilitate this activity.
NO SYSTEM DISRUPTION
Customer will not use, or allow others to use, the
Service to disrupt eWorld's network or computer
equipment owned by eWorld or other eWorld customers.
This includes, but is not limited to, improperly
interfering with, inhibiting, degrading, or restricting
the use and operation of the Service by others, sending
excessive data transfers (as determined in eWorld’s
reasonable discretion) for the package or tier of
service to which Customer subscribes or modifying or
altering in any manner any modem or modem configuration
so as to allow its use beyond the parameters outlined by
the specific level of service to which Customer
subscribes. Any static or dynamic IP address must be
authorized and provisioned by eWorld. Altering any IP
address provisioned by eWorld or otherwise cloning
another user’s IP address is prohibited. Customer also
agrees that Customer will not use, or allow others to
use, the Service to disrupt other Internet Service
Providers or services, including but not limited to
e-mail bombing or the use of mass mailing programs.
In addition, Customer will not, or allow others to,
alter, modify, service or tamper with the eWorld’s
Equipment or Service or permit any other person to do
the same who is not authorized by eWorld.
Security
Accessing or attempting to access any of eWorld’s
equipment, equipment hosted by eWorld or eWorld Customer
Premises Equipment out with the normal range of services
provided is strictly prohibited. Commonly referred to as
hacking or cracking this includes, but is not limited
to, attempting to read or modify any system files or
interact directly with the operating system, or any
action which has the express purpose of interfering with
the normal running of any equipment on or connected to
our network.
The following actions are considered by eWorld to be
direct interference with our equipment and are
prohibited. Specifically, but without limitation:-
Forgery of addresses or other such data in IP packets or
emails
Unauthorized access to the network management equipment
of eWorld or other Internet providers or their customers
Mail bombing; mass mailing of unsolicited advertising
material
The transmission of live video or live audio
The use of IP multicast without authorization
Use of packet sniffers and other forms of electronic
surveillance devices
Any form of OOB Attack, eg Winnuke
Any Denial of Service Attack
Satan Scans, Port Scans, Ping Scans, Ping Floods, SYN
floods
Telnet to any of our systems
Attempts to use Rcommands to any of our systems
Attempts to guess or crack user names or passwords
Accessing or attempting to access any account without
authority
-are considered to be unacceptable practice and may
result in eWorld taking immediate action to suspend or
cancel the account or accounts of the offender. eWorld
may, at their sole discretion, report the incident to
the Police and circulate such details about the offender
to other Internet Providers as to enable them to impose
such sanctions as they see fit.
System Resources.
You are expected to make responsible use of our system
resources. Unless included in your service order the
running of any servers, including Web Servers, Game
Servers, Mail Servers, FTP Servers or IRC Servers is not
allowed and may lead to immediate suspension of your
account.
We reserve the right to end all or any sessions which
have been idle for in excess of 15 minutes or calls with
duration in excess of 6 hours. You may not run any
processes on our system which continues after you have
logged off, nor may you run excessive concurrent
processes on our system.
Your Account
Unless specified to the contrary in your service order
your account is for your company/business use only. You
should keep your user name and password supplied by
eWorld secure and you must not pass them on to any other
individual or group of people. You should be aware that
you are responsible for the actions of anyone using your
account and your liability under the law is not
necessarily limited.
Electronic Mail
The normal use of mail is perfectly acceptable. However,
customers should be aware that the contents of any email
message may not necessarily be private when it is
transmitted across the Internet. Highly confidential or
personal information should not be sent using email and
while eWorld make every effort to protect accounts from
unauthorized access no guarantees are implied or can be
given that mail is secure.
Email Accounts
eWorld has a set mail quota of 3MB per mailbox unless
mentioned otherwise in the service order and will not
normally limit the size of a file being mailed to or
from our systems. However, eWorld reserves the right to
delete all mail from any mailbox residing on our system
when the amount of disk space exceeds 3MB for a period
in excess of 21 days. Should the volume of mail threaten
the proper functioning of eWorld systems eWorld reserves
the right to delete all the mail and return any new
messages to the sender without delay. eWorld will make a
reasonable effort to contact the customer if time
permits but operational considerations will have
priority.
An Email account exists only as long as an account is
held with eWorld. It is the responsibility of the
account holder to collect any mail prior to
cancellation. In the event that eWorld cancels an
account due to infringement of eWorld’s Terms and
Conditions or in breach of this AUP all mail stored on
eWorld systems will be automatically deleted 7 days
after termination. In addition, any email provided free
of cost with your Internet account is subject to
suspension and ultimate deletion and termination of the
email account after one month of Internet account
expiration. On application to eWorld and subject to any
outstanding payments or handling charges being made
eWorld will forward the mail to any new address as
instructed in writing.
eWorld prohibits the use of private mailing lists run on
eWorld systems unless written authority to the contrary
is obtained.
NO IMPERSONATION OR FORGERY
Customer will not impersonate, nor allow others to
impersonate, another user, falsify one's user name,
company name, age or identity in e-mail or in any post
or transmission to any newsgroup or mailing list or
other similar groups or lists, or knowingly or
unknowingly create or use an email address that has the
effect of being misleading. Customer will not, nor
allows others to, forge any message header of any
electronic transmission, originating or passing through
the Service. Customer will not, or allows others to,
forge anyone else’s digital or manual signature.
NO ABUSE OF NEWSGROUPS
The Customer will not, nor allow others to, post or
transmit any private, third party e-mail to any
newsgroup or mailing list without the explicit approval
of the sender.
Customer will not, or allow others to, post messages
that do not comply with or are not permitted by or
otherwise violate the newsgroup’s terms of use, written
charters, FAQ or similar instructions or guidelines.
Customer will also not circumvent the approval process
for posting to a moderated newsgroup and will not
“flood,” “newsbomb” or otherwise disrupt users of
newsgroups by posting a large number of messages to a
newsgroup with the intent to hinder normal discussion,
cancel messages of others (except as an authorized
moderator), send excessive quantities of data to a
newsgroup, post binary files to newsgroups that do not
expressly permit them or download any newsgroup in bulk
unless expressly permitted.
USE OF CHAT ROOMS AND SIMILAR INTERACTIVE PROGRAMS
Customer will not, or allow others to, participate in
chat rooms, bulletin boards, discussion groups or other
interactive sections of the Internet (“Chat Rooms”) that
Customer or a person using Customer’s service has been
banned from using. Customer will not, or allows others
to, violate the Acceptable Use Policy of the server or
Chat Room. In addition, Customer will not, or allow
others to: flood or scroll such Chat Rooms (sending
messages or material in quick succession with the intent
to disrupt use of such Chat Rooms by others); use
automated programs such as “bots” or “clones” to
participate in Chat Rooms unless Customer is physically
present at Customer’s computer; manipulate any Chat Room
server to harass or disconnect other Internet users or
to gain privileges that Customer is not entitled to;
send Chat Room messages to recipients who have indicated
their desire not to receive such messages; or forge
alter, or hide Customer’s identity.
NO EXCESSIVE USE OF BANDWIDTH
If eWorld determines, in eWorld’s sole discretion, that
Customer is using an excessive amount of bandwidth over
the eWorld network infrastructure for Internet access or
other functions using public network resources, eWorld
may at any time and without notice, suspend excessive
bandwidth capability, suspend Customer’s access to the
Service, require Customer to pay additional fees in
accordance with eWorld’s then-current, rates for such
service, or terminate Customer’s account.
NO “VIRUSES”
Customer will not use, or allow others to use, the
Service to transmit computer “viruses,” worms, “Trojan
horses,” denial of service attacks or other harmful
software programs or information containing any lock,
key, bomb, worm, cancelbot, or other harmful feature.
Customer will use standard practices to prevent the
transmission of such viruses, or other harmful software
and information. As software or other content downloaded
from the Service may contain viruses, it is Customer’s
sole responsibility to take appropriate precautions to
protect Customer’s computer from damage to its software,
files and data.
RIGHT TO MONITOR
Neither eWorld nor any of its affiliates, suppliers, or
agents have any obligation to monitor transmissions or
postings (including, but not limited to, e-mail,
newsgroup, and instant message transmission as well as
materials available on the personal web pages and online
storage features) made on the Service. However, eWorld
and its affiliates, suppliers, and agents have the right
to monitor these transmissions and postings from time to
time for violations of this Policy and to disclose,
block, or remove them in accordance with the Subscriber
Agreement and any other applicable agreements and
policies.
OTHER SERVICE PROVIDERS’ ACCEPTABLE USE POLICIES
eWorld obtains services from and relies upon many other
entities to provide the Service to Customer. Where
Customer accesses services of other entities through the
Service, Customer agrees to and shall abide by the
publicized acceptable use policies of such other known
entities.
NO WAIVER
The failure by eWorld or its affiliates to enforce any
provision of this AUP shall not be construed as a waiver
of any right to do so at any time.
Reporting of Abuse or Spam
eWorld will always respond to complaints about UCE/UBE/SPAM
or any abuse and any incidence should be reported to
abuse@eworld.net.pk for abuse and spam@eworld.net.pk for
spam. When reporting, please provide with following
information:
* Offending email(s) with full-header information.
eWorld (Pvt) Limited may take the following actions
against the reported abuse:
• Contact the alleged party and issue warnings
• Suspend/terminate the alleged account
• Pass the information to the proper govt. authority
upon a formal, written request
• Initiate legal action to collect damages
REVISIONS TO POLICY
eWorld reserves the right to update or modify this
Policy at any time and from time to time with or without
prior notice. Continued use of the Service will be
deemed acknowledgment and acceptance of the policy.
Notice of modifications to this Policy may be given by
posting such changes to eWorld’s homepage (www.eworld.net.pk),
by electronic mail or by conventional mail.
